Let the wailing begin

Schadenfreude (n): satisfaction or pleasure felt at someone else’s misfortune.

Hoo-boy. This is a day myself and every sane person on this planet has been waiting for. The birthers – that bunch of insane racists who cannot accept that a black man is in the White House – have finally received the smack-down they’ve deserved for so long.

You see, after years of crying that Obama was born in Kenya, that he had forged his birth certificate, that he wasn’t eligible because his father was Kenyan, that the founding fathers wanted both parents to be American (you know, just like they wanted America to be Christian), the movement – led by crazy bitch Orly Taitz – finally convinced a judge to listen to their conspiracy theories. However, despite countless claims of the case going to the Supreme Court, this ended up in the administrative court of one Judge Malihi in Georgia, who had to decide whether or not Obama qualified to appear on the presidential ballot come November. Of course, this isn’t the first time that Taitz has dragged Obama’s eligibility to court. Oh no, in fact it seems as if this dentist-turned-lawyer (isn’t that just the American dream?) has found a lucrative income stream from gullible morons, who she can fleece whilst filing no-hope petitions. But maybe I just have a bad impression of lawyers.

Now here’s where it gets interesting.

Obama and his lawyer declined to even attend the proceedings. Now, to be honest, I don’t know if this was the smartest move on their part, although it does give the indication of the contempt in which they hold Taitz (who, ironically was born in what is now Moldova) and her ilk. Doing so left the door open for the judge to issue a default judgement against them, something one bunch of right-wing fuckheads actually think happened.

The “Conservative Action Alerts” cesspit of stupidity put up a screaming banner, on January 27th, which proclaimed “Georgia Judge Orders Obama off the Ballot” and then went to to try elicit contributions froms its readers so they could “Tell Every OTHER Secretary of State to REMOVE Obama NOW:” (And yes, the article carries on IN THAT VEIN… more proof that insane idiots are incapable of decent page design and formatting.) I, for one, can’t wait to see how they react this latest development.

In the real world, however, this didn’t happen… ironically, because Taitz and her cohorts insisted on arguing the case on its merits. So the judge sat down and listened as Taitz wheeled out her witnesses, which included:

  • The claim that the witnesses had prima facie standing as electors and could therefore complain to the court to seek relief from having a candidate who they believe is a criminal appear on their ballot papers.
  • “Evidence” that Barack Obama’s birth certificate offered on the Internet was a forgery.
  • “Evidence” that Barack Obama is using a fraudulently obtained Social Security Number.
  • Taitz even called a witness to say that if Obama presented these documents at the border, he’d be arrested and deported.

The good judge listened to all of this (no doubt face-palming a few times)… and threw it all out. As he said in his judgement, the evidence was “unsatisfactory” and “insufficient to support plaintiffs’ allegations” and the of the witnesses, “None of the testifying witnesses provided persuasive testimony. Moreover, the Court finds that none of the written submissions tendered by Plaintiffs have probative value.”

It’s beautiful. In one fell swoop, the birthers managed to have all their “evidence” declared virtually null-and-void. But that wasn’t what swayed the judge. He referred to a case in an Indiana court, which rules that “a person qualifies as a natural born citizen if he was born in the United States because he became a United States citizen at birth.”

Which is what sane, non-racist people have been saying all along.

I for one, can’t wait to hear the wailing and gnashing of teeth coming from this group of pathetic individuals. I wish I could say that this is the end of them, but sadly, it takes more than losing a court case to silence a racist scumbag. Still, I’ll keep my ear to the ground and report on the more interesting responses.

So far World Nut Daily, have been incredibly mild in their reporting thereof, which does – admittedly – boil down to them going “What the Fuck, your Honour?!” Or as one of the plaintiffs put it:

“If Obama has the burden of proof, and failed to show up, clearly he didn’t carry the burden,” he told WND. “The judge here completely ignores that.”

Wrong. The judge looked at what crap you had to offer and realised there was no burden of proof.

        He’s already into the “Obama threatened/bribed the judge” meme, although he doesn’t say it himself but quotes others. Only the first of the conspiracy theories, I’m sure.

          I love how Terry goes from “What you call “a friendly venue” is actually a judge willing to—well, judge. Sorry if you don’t like a judge who doesn’t rule according to your pre-determined conclusions, but that’s the way it is.” before the case, to “We have discovered a thoroughly corrupt judiciary.”

          It’s beautiful.

              I laughed out loud when I saw that. Paranoid man on a backwater blog equals American heroes. I like how Terry entertains the fantasy that he’s some kind of journalistic hero, when he’s anything but. His cries of “corruption” and that he has “clear and convincing evidence of a fix” are laughable. Sadly, we also knew this would be the reaction all along.

    I still can not fathom how you can present a case so bad that no defence is better? How? I was fully expecting Obama to lose on the technicality he did not show up but the judge would dismiss all the the plaintiffs claims. Their claims were so bad that they formed an legal negative, this must be unprecedented in law.

      That’s the beautiful irony of it. The judge could have issued a default judgement, but they insisted on arguing the “merits” of their case, upon which he facepalmed and threw it out.

        The best part of it is that the nutters who continue to believe Obama isn’t a citizen will go to further lengths to “prove” their way of thinking.

        I can’t imagine how lulzy it will be, the things they think up next.
